Ministry of Communications had initiated a public consultative process to develop a modern and future-ready legal framework in telecommunication.

With 117 crore subscribers, India is the world’s second largest telecommunication ecosystem. The telecommunication sector employs more than 4 million people and contributes about 8% of the country’s GDP.

The existing regulatory framework for the telecommunication sector is based on the Indian Telegraph Act, 1885. The nature of telecommunication, its usage and technologies have undergone a massive change since the era of “telegraph”. The world stopped using “telegraph” in 2013.

In the past eight years, the Government has taken several initiatives for the growth of the telecommunication sector. It is in this context that we have taken up the initiative to restructure the legal and regulatory framework for the telecommunications sector.

The Bill will replace the existing legal framework governing telecommunication in India, comprising of the Indian Telegraph Act, 1885, the Wireless Telegraphy Act, 1933 and the Telegraph Wires (Unlawful Possession) Act, 1950.

In July 2022, a Consultation Paper on ‘Need for a new legal framework governing Telecommunication in India’ was published and comments were invited. Comments have been received from various stakeholders and industry associations.

Based on the consultations and deliberations, the Ministry has now prepared the draft Indian Telecommunication Bill, 2022. To facilitate further consultations, an Explanatory note to provide a brief overview of the Bill has also been prepared.

Citizens are invited to share their comments on the Draft Indian Telecommunication Bill 2022 on the MyGov Platform.

SIR, GA, ONE POINT TO BE ADDED IN THE DRAFT FOR TELECOMMUNICATION BILL IS THERE MUST BE SOME KPI ON THE BASIS OF KPI THERE SHOULD BE BONUS/INCENTIVE/REBATE/PANALTY MUST BE IMPOSED. IT GIVES ALL PARTY TO EVALUATE THE PERFORMANCE OF THE SERVICE PROVIDER SO THAT THERE WOULD BE NO CONFICT IN FUTURE. SIR THERE IS AN PROVISION FOR PANELTY BUT WE HAVE TO HAVE PARAMETER ON WHAT BASIS PANELTY WILL BE IMPOSE OR BONUS/ INSENTIVE/ REBATE IS TO BE GIVEN. THIS WILL ENSURE EASE OF DOING BUSINESS. what about service providers not following rules and regulations laid down and consumers should be benefited and should not be swayed away and run from pillar to post for their grievances

This bill does not contain any regulation in fixing 3 g 4 g and 5 g data by consumers besides fixing charges for voice calls and SMS The existing BSNL not proposed to be strengthened to compete private service providers to boost govt revenue The existing min charges for top up and duration should be done awaywith

Respected PM, Following points should be considered while considering tele communication development : 1.Building strong networks is essential but at the same time it should be seen that no trees are cut for installing towers. 2.Strict restrictions should be put on Tele-marketing companies. They should not be allowed to disturb the people by calls or messages. Fines should be imposed 3. Mobile operators should help maintain privacy of users 4. Time to time ( e.g yearly ) Aadhar verification should be done so that only authorized people are using mobiles and it is not used for fraudulent purposes 5. Data accumulation should be provided by operators, i.e unused that of Day can be used on some other day 6. Service providers should connect every part of country I.e. there should be no range problem in any part of country. 7. Proper way of disposal of used mobile phones should be taught so as to control E- Waste
