Inviting Suggestions on Draft India Data Accessibility & Use Policy 2022

The draft India Data Accessibility and Use Policy was published on MeitY website on February 21, 2022. Since its publication, MeitY has been receiving several comments and suggestions on the draft policy. It’s also observed that there is a need to bring in some more clarity with regard to some of the clauses in the draft policy so that the objectives of the Data Accessibility policy to enable better services is made amply clear. These clauses will be finalized after getting inputs of stakeholders in the consultation process Accordingly the draft policy document for consultations is being shared here.

Government e-Marketplace owes its genesis to the recommendations of two Groups of Secretaries made to the Prime Minister in January 2016. They recommended setting up of a dedicated e-market for different goods & services procured or sold by Government/PSUs besides reforming DGS&D. Subsequently, the Finance Minister in his Budget speech for FY 2016-17, announced setting up of a technology driven platform to facilitate procurement of goods and services by various Ministries and agencies of the Government.

In EU, the right to privacy is a fundamental right which seeks to protect an individual‟s dignity. The European Charter of Fundamental Rights (EU Charter) recognizes the right to privacy as well as the right to protection of personal data The EU possesses a comprehensive data protection framework which applies to processing of personal data by any means, and to processing activities carried out by both the Government as well as the private entities, although there are certain exemptions such as national security, defence, public security, etc.

The upcoming Data protection regime will widen the scope by offering a comprehensive data protection framework which shall apply to processing of personal data by any means, and to processing activities carried out by both the Government as well as the private entities- not only Body Corporate.
