•Cases, which in the opinion of the Bench, may provoke enmity amongst communities likely to result in a breach of law and order.
•Recording of evidence, including cross-examination.
Privileged communications between the parties and their advocates; cases where a claim of privilege is accepted by the Court; and non-public discussions between advocates.
•Any other matter in which a specific direction is issued by the Bench or the Chief Justice.

•Matters registered under or involving the Protection of Children from Sexual Offences Act, 2012 (POCSO) and under the Juvenile Justice (Care and Protection of Children) Act, 2015.
•In-camera proceedings as defined under Section 327 of the Code of Criminal Procedure, 1973 (CrPC) or Section 153 B of the Code of Civil Procedure, 1908 (CPC).
•Matters where the Bench is of the view, for reasons to be recorded in writing that publication would be antithetical to the administration of justice.

The following can/will be excluded from live-streaming:
•Matrimonial matters, including transfer petitions arising thereunder.
•Cases concerning sexual offences, including proceedings instituted under Section 376, Indian Penal Code, 1860 (IPC).
•Cases concerning gender-based violence against women.

The Rules are part of the National Policy and Action Plan for implementation of Information and Communication Technology (ICT) in the judiciary.
The Rules would cover live-streaming and recording of proceedings in High Courts, lower courts and tribunals.

To have greater transparency, inclusivity and foster access to justice, the e-Committee has undertaken the project of live streaming of court proceedings on priority.
This will enable access to live court proceedings, including on matters of public interest to citizens, journalists, civil society, academicians and law students on a real-time basis, which was not otherwise possible owing to geographical, logistical or infrastructural issues.

Purpose of the Rules
The Draft Rules aim to bring transparency, inclusivity and foster access to justice. With the draft model, the proceedings of the court will be live-streamed, including matters of public interest to citizens, journalists, and other stakeholders.

i think its a good idea to live stream the court proceedings. people will have a clear idea of what's happening on, thus facilitates a greater transparency.

According to me there are following pros and cons of this rule: 1.PROS- Transparency, Understandability, Reliability, Convenient, Witness Credibility, Cost effective, reduction in thousands of petitions etc. 2. CONS- IT Security issues, Control issues, Breach of data security, Problems in protecting integrity of testimony, illegal recording, Risk to confidentiality etc. The rule for live streaming and recording of hearing in its present form may require severe modification and steps.

Well recently we hv seen crimes during live streaming. I hope court prevail justice in such cases within 1month. same for cctv or recording.and specially under rape cases live streaming of cases is better. and govt nd court make death sentence in these cases. nothing has changed or improved if we see the number of cases nd the verdict they received. even punishment is not severe. girls r left with a life which cannot be considered living death is better than living but they breath 4 justice
