Brief Background of the Real Estate Act, 2016

The Real Estate (Regulation and Development) Bill was passed by the Rajya Sabha on 10th March, 2016 and by the Lok Sabha on 15th March, 2016. The Bill as passed by the Parliament was assented to by the Hon’ble President on 25th March, 2016. The Real Estate (Regulation and Development) Act, 2016 was published in the Official Gazette on 26th March, 2016 for general information. The Real Estate Act, 2016 aims at protecting the rights and interests of consumers and promotion of uniformity and standardization of business practices and transactions in the real estate sector. It attempts to balance the interests of consumers and promoters by imposing certain responsibilities on both. It seeks to establish symmetry of information between the promoter and purchaser, transparency of contractual conditions, set minimum standards of accountability and a fast-track dispute resolution mechanism.

Brief Background of the Draft Rules under the Real Estate Act, 2016

Specified sections of the Real Estate (Regulation and Development) Act, 2016 have come into effect from 1st May, 2016, including section 84 of the Act which provides that “the appropriate Government shall, within a period of six months of the commencement of this Act, by notification, make rules for carrying out the provisions of the Act” i.e. by 31st October, 2016. As per section 2(g)(i) of the Act, the Ministry of Housing & Urban Poverty Alleviation is the appropriate Government for Union Territories without Legislature.

In this regard, the Ministry has prepared the draft Rules on which the Ministry proposes to elicit general comments through the open forum for discussion on the MyGov portal.

sir,once legislation is done,some shortfall remains which spoils basic concept,our law maker need to verify,its impact before scraping the draft planner,or check if change require to strengthen,real estate issue start after occupancy/maintenance/register society for ownership,small society collection is less than cost for maintenance/audit/election,nobody want to take any responsibility due to lengthy society rules,

Indian education system has to change from its traditional ways of teaching to as per the requirements of industry. it has to be more practical then theoretical. I am afraid to tell current condition of colleges, specifically govt. coll. they are just bound to books, having no idea about the world outside. in a way its not their mistake, they are just following the path, one which showed their trainer. and this is where we need to work, to put push them into open world, let them persuade dream

Sir, There is still no clarity on under construction projects which have been delayed significantly and still there is no sign of completion. Do those homebuyers get penalty as per this RERA bill. Will they get compensation for change in original plan. How the escrow account will be set for under construction projects . please give some relief to harassed common man by bringing under construction projects under this law and clear rules for them .

In real estate bill there should be some amendments keeping sustainable development in mind. 1) Like to mandatory rain water harvesting ie to collect rain water of roof and premises or total concrete area by making underground tanks and reservoir which can be used in domestic purpose. 2) To plant tree or fruit giving tree atleast in ratio of 1:2 means 1 tree for 2 flats in an apartment. 3) To implant solar plate on roof to light common road & stairs which falls under building premises

The success of any bill / law depends on its simplicity and effective implementation. Just making law will not serve the purpose. The basic problems of consumers, I repeat consumers are 1. Cheating in terms of legality of property. 2. Muscle power of builders. 3. Govt policies that favours builders, Banks and Investors. 4. Govt itself wants to build concrete jungle in entire country by giving lots of tax benefits. If anyone interested can study IT rules. 5. Power of black money.
